Please read through our Terms and Conditions, we ask that you familiarise yourself with them before contracting us for any work. If you are using or have used our service it is understood that you have agreed to the terms described on this page.

When we say “We” “The Web Dojo, “US” and “our service” we are referring to The Web Dojo and its respective products and services. References to “you” “your” “customer” “client” and the like, refer to you, and your agents. These Terms and Conditions can change at any time. It is important that you check back here frequently for any changes. Your continued use of this website implies acceptance of any subsequent revisions.

The Web Dojo’s liability is limited to the amount paid by the customer to The Web Dojo for any work undertaken.

Website Design + Development

Payment

First payment is a 50% deposit, which needs to be made on approval of the specification. Work will only commence after initial deposit is paid. This includes initial design concept work.

Final remaining 50% payment is to be made when the site is “live”.

Any extra work such as scripting, design or image editing commissioned outside this brief is charged at $100/hour.

Full payment is due on Invoice. Payment terms are strictly 7 days from invoice date. Ownership of website and all works is only transferable from THE WEB DOJO once full payment is made.

Project

Once design has been agreed upon by the client and development has been started by THE WEB DOJO, should the client wish to redesign the website, THE WEB DOJO reserves the right to charge an extra fee for the extra hours involved.

THE WEB DOJO is to deliver the final result as expected and outlined by the client in the project brief, using methods of it’s own choice. THE WEB DOJO uses best practices for design and development, and reserves the right to deliver the final outcome with design and development process of their choice. The client may suggest preferred methods or frameworks, however THE WEB DOJO is the final authority on making the choice should it not adhere with THE WEB DOJO’s standards and practices. Support

All our websites come with 1 month free support after launch for any teething issues. This includes basic content and layout fixes, minor colour changes and page additions.

For any major functionality changes (for example, adding an e-commerce option or completely changing the website layout), this is NOT included, as this is not ‘support’, this is extra work which will be quoted as such.

Anything that is deemed as not included in the 1 month support will be decided by THE WEB DOJO, based on fair judgment of hours and work involved. It is not negotiable.

Security

While we develop and implement sites with good security practices, it is never a guarantee from malicious attacks online. THE WEB DOJO is not responsible for any security breaches to your website OR hosting provider. We will assist where possible, and any extended work may be billed, which we will notify the client about beforehand.

THE WEB DOJO do not take ongoing backups of a clients website by default, and subsequently are not responsible for any information or data loss. THE WEB DOJO can offer to take seperate backups of a clients website at request for a fee.

SEO

There are never guarantees with SEO – THE WEB DOJO do however guarantee our best realistic efforts to deliver desirable results. THE WEB DOJO uses calculated research with premium industry tools and data to achieve this as best as possible.

SEO is charged monthly upfront. No lock in contracts, if cancelled within the month, service will complete the last day of the said month. Invoices to be paid for SEO campaigns for upcoming months are delivered to the client by THE WEB DOJO by the 26th of the previous month, and are strictly due by the 3rd of the upcoming billable month. Failure of payment for SEO invoices will result in upcoming monthly SEO activities being halted until payment is made.

THE WEB DOJO uses practical standards and the latest recommended practices to try and achieve desired results for their clients. THE WEB DOJO cannot however control the way that search engines adjust their ranking factors, algorithms and guidelines, and any subsequent negative change in ranking cannot be guaranteed or ruled out. THE WEB DOJO simply tries to adhere to recommended practices by major search engines at any given time.

THE WEB DOJO may suggest timeframes where results may be seen, however cannot guarantee nor are responsible to commit to any timeline in any way. It is simply given as a optimal reference, but we cannot foresee any circumstances that may affect the said results achieved.

WEBSITE MIGRATIONS

While we take a backup of the website content and data, The Web Dojo is not responsible for any data corruption. We always recommend that the client also takes their own backup of website content and data.

The Web Dojo will strive to ensure any downtime is kept at an absolute minimum, however during the DNS cutover there may be a period where downtime may occur. Downtime includes images and internal website links not working correctly until they are updated to reflect the new path (this cannot be completed and tested until afterthe DNS cutover). Any downtime that occurs will be kept to a minimum, however does not affect the cost and invoicing of the migration.

Web host based email backup is the responsibility of the client, and while The Web Dojo may provide assistance and advice, it is purely for advice purposes only as this is not our area of expertise.

The Web Dojo does an initial evaluation of any hosting environment, however ultimately the responsibility of hosting compatibility (including software versions, scripting versions, mailing version and security) with the clients website and functionality should be confirmed by the client with the hosting providers technical support team prior to the website migration.
